The defendant was reportedly operating a 22-foot boat when it struck a channel marker near the docks of an Indian River County marina and restaurant on July 24, 2010. The accident caused Carlson's wife, Julie, to slam against the marker and sign.
She died the following day at the Holmes Regional Medical Center in Melbourne.

A sample of Carlson's blood was taken three hours after the 10:18 p.m. accident, the affidavit stated. The BAC level then was 0.076, according to the affidavit.
