LAKE PLACID - The suspect in a Sept. 7 drive-by shooting in Highway Park is next scheduled to appear in court Nov. 12 for a pretrial conference.
Elbert McFarlane Heron, 28, of 130 Zion St., is charged with second-degree attempted murder, discharging a firearm in public, firing into an occupied dwelling, vehicle or building and firing into an occupied vehicle.
Heron pleaded not guilty to the charges on Oct. 20. He remained in Highlands County Jail Friday in lieu of a $110,500 bond.
The charges stem from the Sept. 7 incident, where sheriff's deputies were called to 114 Anderson St., in Lake Placid, in reference to the alleged drive-by.
One of the shots struck a vehicle parked in front of the home. Inside that vehicle at the time of the shooting was a two-month-old baby.
The bullet hit the center of the trunk and exited the rear window brake light above the infant's head, according to court documents. Another round struck the home on the southwest corner, while two others hit a second parked vehicle. No one was injured.
Victims told investigators they saw Heron fire in their direction. Two dropped to the ground when they heard "rapid fire."
Eight spent shell casings were recovered from the area.
Heron reportedly told a witness he was approached by another male about a problem he was having with one of the victims. He said he went to someone's house and they pulled a gun on him and tried to cock it.
He reportedly told the witness he went to his car, retrieved his AK-47 and started firing.
The Nov. 12 pretrial conference is set for 9 a.m.
